The High Court in Jammu has quelled the order whereby the services of the petitioner were dismissed on the basis of accusation of unsanctioned absenteeism from duty.
While quelling the termination directive of Abdul Rashid Durrani, an employee of the Tourism Department, Justice Ali Mohammad Magrey said that the accounts bear evidence to the fact that satisfactory opportunity of trial has not been delivered to the petitioner and the rules of expected impartiality have been made a casualty.
The justice added that the rules concerning sensibleness, good faith, justice, fairness and good integrity, which are a part of law, relating to administration of justice and equality, have been followed in breach and, consequently, it has triggered failure of justice.
