On Rushikonda Tourism Project, Supreme Court found errors with NGT stay orders

On Tuesday, the Supreme Court of India found errors with the orders issued by the National Green Tribunal. The orders stopped the construction works of the tourism project at Rushikonda Hills in Vizag, Andhra Pradesh.

The government of Andhra Pradesh State has appealed against the NGT order stopping the complex construction taken up by the APTDC at Rushikonda in Vizag. B R Gavai and Hima Kohli, a vacation bench of Justices, explained that it had believed that the NGT jurisdiction was accessible to people who cannot go to courts. The bench stated that the National Green Tribunal is currently addressing letters from the Members of Parliament as well. They had considered that this jurisdiction was accessible for only the have-nots and other ordinary citizens. The Supreme Court held that as petitions, only letters written by the ones who are not in a position to reach the courts should be addressed as petitions and not by an MP.

Abhishek Manu Singhvi, a senior advocate, who pinpointed the disagreement on behalf of the state government, explained that the APTDC project is hoped to generate employment to more than 300 people and that in the said project, the government had invested Rs 180 crore. To stay the project, NGT first passed an ex-parte order, and then confirmed the order by declining the opposition of the state on May 20th. When 50% of the work was done, the stay order was passed.
