A significant change is being introduced for Indian scholars, researchers, professors, physicians and other J-1 visa holders travelling to the United States. Under a final rule published by the US Department of Homeland Security, admission for J exchange visitors will be changed from duration of status to a fixed admission period from 15 September 2026. An authorised stay will generally be limited to the programme period shown on Form DS-2019 or four years, whichever is shorter. Additional time may still be granted, but a formal extension of stay application will be required. As a result, academic mobility, research travel, family journeys and international conference plans may be affected by firmer immigration deadlines and additional administrative procedures.

International Travel Will Require Greater Caution

The strongest travel impact may be experienced by scholars who leave the United States while an extension application is pending. Travel to India may be required for family responsibilities, academic collaboration, fieldwork, medical needs or university holidays. Trips to other countries may also be planned for conferences and research assignments.

Under the final rule, an extension application will not automatically be treated as abandoned merely because a J-1 visitor departs while it is pending. However, that protection will apply only when the previously authorised admission period has not expired and readmission is being requested for the remaining portion of that period.

An application may be treated as abandoned when a visitor leaves and later seeks admission using a Form DS-2019 carrying a programme date beyond the previously authorised admission period. A copy of Form I-797C, confirming receipt of the extension application, should be carried during such travel. The appropriate Form DS-2019, passport, valid visa and other supporting records will also be needed.

Long-Term Research May Require Formal Extensions

Programmes lasting longer than four years will not necessarily be prohibited. However, they will be subjected to an additional USCIS approval stage. An extension may be granted for the period needed to complete the programme shown on Form DS-2019, subject to regulatory restrictions and a maximum extension period of four years at a time.

The application will have to be filed in the form and manner specified by USCIS. A valid Form DS-2019, the required fee and any requested biometric information will have to be submitted. The application must be received before the authorised admission period expires. The 30-day preparation-for-departure period may be included when timely filing is assessed.

If an extension is refused after the authorised admission period has ended, immediate departure will be required. The same consequence may be applied to accompanying dependants whose status has been derived from the principal J-1 visitor.

Work Continuity Has Been Partly Protected

Some protection has been provided for J-1 visitors whose timely filed extension applications remain pending. Authorised employment and activities consistent with the exchange programme may generally be continued for up to 240 days after the admission period expires.

A transitional safeguard has also been established. When an extension application is filed on or before 18 March 2027, authorised employment and programme activity may be continued while the application remains pending, up to the programme end date recorded on the Form DS-2019 submitted with the application.

Nevertheless, continued activity must remain within the approved programme. Unauthorised employment or a failure to maintain status may weaken an extension request. Early filing and institutional oversight are therefore likely to become more important for Indian researchers employed by universities, hospitals and scientific organisations.

J-2 Families Will Face Parallel Requirements

Indian scholars accompanied by spouses or unmarried children under 21 may also face additional procedures. J-2 dependants will need to be included in the principal visitor’s extension request or submit separate applications when their stay must be prolonged.

The qualifying family relationship will have to be demonstrated, and lawful status must have been maintained. Unauthorised employment must not have been undertaken. An extension granted to a J-2 dependant cannot exceed the authorised admission period of the principal J-1 visitor.

Family travel may consequently require more careful coordination. Passport validity, school calendars, employment authorisation and return flights will need to be aligned with the fixed admission dates of every family member. Separate Forms DS-2019 will continue to be required for accompanying dependants.

Existing Visa and Entry Requirements Remain Important

Indian applicants must still be accepted by an approved exchange organisation and registered in SEVIS. The relevant SEVIS I-901 fee must ordinarily be paid, and Form DS-2019 must be obtained before a J visa application is completed.

A passport generally must remain valid for at least six months beyond the intended stay, unless an applicable country-specific agreement provides otherwise. Form DS-160, supporting documents and any required application fee must also be presented through the established visa process.

Exchange participation cannot legally be undertaken using a B1/B2 visitor visa. Entry under the Visa Waiver Program is also unavailable for Indian nationals and cannot be substituted for J-1 exchange status. Moreover, exchange visitors ordinarily cannot enter the United States more than 30 days before their programme begins.

Flight Bookings and Re-entry Plans Must Be Checked

Non-refundable flights should not be booked until the required visa and travel documentation have been secured. Scholars returning to India for a visa renewal or new visa category may face embassy appointment requirements and administrative processing. A change of status approved within the United States does not automatically produce a visa for future international travel.

If the United States is left after an in-country change of status, a new visa in the appropriate category may be required before re-entry. A valid visa held in an expired passport may still be used with a new valid passport, provided the visa has not been cancelled or revoked and remains appropriate for the planned journey.

The Form I-94 record should be downloaded and examined after every arrival. Under the fixed-period system, this document will become especially important because the authorised departure deadline will be recorded there.

Early Institutional Planning Will Become Essential

Indian scholars should be advised to begin extension discussions well before their authorised stay expires. Programme sponsors, university international offices and immigration advisers should be consulted whenever research dates, institutional affiliations or funding periods are changed.

The passport, J-1 visa, Form DS-2019, SEVIS record, Form I-94 and USCIS receipt notices should be maintained together. Copies should also be carried when international travel is undertaken during a pending extension. A return journey should be evaluated against the existing authorised admission date rather than only against the later date shown on an updated DS-2019.

The final rule does not end academic exchange between India and the United States. However, a more controlled system is being created. Greater responsibility is being placed on visitors to obtain direct USCIS approval when additional time is required. For Indian researchers and their families, legal status and international travel will therefore have to be managed as closely as the academic programme itself.
