Air Canada regulations to assist people with disabilities are made by the Canadian Transportation Agency

The CTA, or the Canadian Transportation Agency, has mandated an administrative monetary penalty. Due to multiple infractions of the ATPDR, or the Accessible Transportation for Persons with Disabilities Regulations, Air Canada is being fined a total of $97,500.

Air Canada has been found to have violated some of the ATPDR’s requirements regarding providing services to individuals with disabilities. 

In August 2023, Air Canada failed to assist a wheelchair user in alighting from its aircraft. The passenger had spastic cerebral palsy and was unable to move his legs. He was denied any assistance and was forced to disembark the aircraft on his own. As the passenger waited at the terminal, Air Canada made no further inquiries about his needs. 

Sections 35(f), 35(h), and 37(b) of the ATPDR were violated.

An ultimatum of thirty days has been given to Air Canada to request a review before the Transportation Appeal Tribunal of Canada.

Furthermore, a number of administrative and financial penalties have been imposed for ATPDR violations. 

The Canadian Transportation Agency, also known as the CTA, is a quasi-judicial tribunal and an independent federal regulator. In the best interests of all Canadians, it assists in guaranteeing the efficient operation of the country’s transportation network. It benefits the communities in which it operates, as well as the people who work and invest in it, as well as the manufacturers, shippers, passengers, and businesses that depend on it. Additionally, it provides consumer protection for air passengers. Lastly, it ensures the protection of human rights concerning the person with a disability for gaining access to a smooth transportation network.
