Australia has introduced new regulations regarding Student visas (Subclass 500) that apply to foreign students who are either intending to study or to visit Australia while travelling with family. The new regulations will come into effect on October 2, 2026, and will determine various factors, including the method of application and changes from one academic program to another. Many foreign students travelling to major destinations in Australia such as Sydney, Melbourne, Brisbane, Perth, Adelaide, or Gold Coast, where universities and vocational training institutes are located, are expected to be impacted by the changes. In terms of actual travellers, the new law means that the status of the visa and application location will be important for their relocation plans.

Most Further Student Visa Applications Must Be Made Offshore

From 2 October, most Student visa holders who want to apply for another Student visa while already in Australia can no longer lodge their applications from within the country.

Applicants who do not qualify for an exemption must leave Australia before submitting the application. They must also remain outside Australia when the new Student visa is granted.

The Department of Home Affairs states that applications lodged in Australia when the applicant is required to apply offshore will be invalid.

The change affects current students as well as some temporary visa holders seeking to move into the Australian student visa system.

For international travellers, this creates an additional planning requirement because leaving Australia and waiting offshore may need to be incorporated into study schedules, accommodation arrangements and international flight plans.

Limited Exemptions Allow Some Students to Apply Onshore

The new rules do not prevent every current student from applying for another Student visa inside Australia.

Exemptions cover specific circumstances. These include students who need up to 12 additional months to complete their existing course with the same education provider, students sponsored by the Department of Foreign Affairs and Trade or Defence and applicants progressing to a PhD.

Other exemptions apply to certain school students and students moving to a higher Australian Qualifications Framework level.

A student who has completed a qualifying course and is progressing to a higher AQF level may therefore still be able to lodge an application from Australia if the other conditions are met.

These exemptions are particularly important for students whose course completion dates and new enrolments overlap with their visa expiry dates.

Family Travel Rules Have Also Changed

The revised system introduces major changes for partners and dependent children of international students.

Most new Student visa applicants can no longer include family members in their application unless they qualify for a specific exemption.

The Department of Home Affairs also states that family members can no longer apply later as subsequent entrants after the Student visa has been granted.

Limited exemptions apply to groups including PhD students, certain government-sponsored students, foreign government scholarship recipients and eligible students from Pacific countries and ASEAN member countries.

The changes can affect families planning to relocate to Australia together. Students and their families may now need to assess separate visa pathways and travel arrangements before booking long-term accommodation or international flights.

Course Changes Must Follow New Requirements

Australia has also tightened the rules surrounding course progression.

Students cannot use a lower-level course simply as a route to extend their stay under the previous pattern of changing studies.

For students applying for another Student visa from Australia after completing an AQF-level course, the next course generally needs to have a higher AQF level to qualify for the relevant progression exemption.

The Department of Home Affairs provides specific rules for course progression, including requirements concerning higher education providers when a student moves between higher education courses.

This makes course selection an important part of visa planning for students considering a second qualification.

Sydney and Melbourne Remain Major Student Destinations

The changes are relevant to travellers heading towards Australia’s major education and tourism centres.

Sydney combines universities and colleges with attractions including the Sydney Opera House, Harbour Bridge and coastal areas. Melbourne is another major international student destination, with universities, cultural attractions, sporting events and regional travel connections.

Students travelling to either city may also plan domestic trips during university breaks, making valid visa status important when travelling internationally and returning to Australia.

Brisbane Perth and Adelaide Also Attract International Students

Brisbane, Perth and Adelaide provide further education and tourism destinations affected by the revised visa framework.

Brisbane gives students access to Queensland’s wider tourism network, including the Gold Coast and Sunshine Coast. Perth provides a gateway to Western Australia’s beaches, nature reserves and regional destinations, while Adelaide connects international visitors with South Australia’s wine regions and coastal attractions.

Students whose visa circumstances require offshore applications may need to account for international travel before returning to these cities.

Existing Applications Are Protected Under Transitional Rules

Students who applied before 2 October 2026 are assessed under the rules that applied when they submitted their application, including any eligible family members listed. This includes those students who applied under the previous arrangements. The department encourages all applicants to be aware of the new requirements when considering making visa, study, travel or relocation arrangements. As such, students studying overseas who are considering relocation to Australia, or extending their Australian study visa or making other travel arrangements should note the new requirements for international students in Australia. Students need to consider these requirements, and any implications for their own circumstances, before making significant travel commitments.
