Fiji Airways vehemently denies the accusations leveled against the company and its Board of Directors in the widely circulated complaint submitted to the Fiji Independent Commission Against Corruption. The complaint pertains to specific charter flights conducted by the airline between Fiji and Israel in September and October 2023.
The allegations primarily revolve around the legality of a Deed of Forbearance and guarantee established between Fiji Airways and the charterer. The charterer encountered difficulties in meeting payment obligations related to the charter flights, prompting the company’s legal counsel to draft the deed as a prudent and lawful measure to safeguard the company’s interests and ensure a feasible payment plan.
Crucially, the transaction did not reduce the total sum owed by the charterer to Fiji Airways for the charter flights. Rather, it organized the payment into several installments. Although a payment installment scheduled for December 2023 was not made, the company is currently in active communication with the charterer and expects to receive the complete payment for the remaining balance of the charter price in the upcoming weeks.
Notably, the deed was not registered on the Personal Property Securities Register as it does not create a security interest in personal property eligible for registration.
Fiji Airways emphasizes that the choice to conduct charter flights to Israel was solely motivated by commercial factors. A comprehensive vetting procedure was undertaken concerning both the charterer and multiple guarantors. This assessment encompassed a review of the charterer’s history of successfully managing international charters and fulfilling financial commitments punctually. The company’s leadership and board of directors made a thoroughly informed business decision to proceed with the charter flights.
Firmly standing by its ethical business practices, Fiji Airways is seeking legal advice to address the false and defamatory allegations. Concurrently, the airline remains committed to transparency and pledges full cooperation with any lawful investigation initiated by the Fiji Independent Commission Against Corruption.
